Parole to Promote the Unity and Stability of Families

On August 19, 2024, the Biden administration will begin accepting applications for Parole in Place submitted by immigrants who meet certain criteria by way of a new program called the Process to Promote the Unity and Stability of Families. This is very exciting news as it seems Parole in Place, previously reserved as a discretionary immigration solution to military members and their immediate family, will now be extended to a much larger body of immigrants nationwide.
In general, a grant of Parole in Place allows an undocumented immigrant already present inside the United States the chance to live and work legally without the fear of deportation. This is because Parole creates a valid form of entry for the applicant, and the immigrant may apply to work legally for the duration of their grant of Parole. As currently structured, this new Parole program would allow an undocumented immigrant to apply for Parole with USCIS if they meet the following criteria:
- They are present in the United States without admission or parole;
- They can prove continuous presence in the United States for the previous 10 years as of June 17, 2024;
- They have a valid marriage to a U.S. citizen as of June 17, 2024;
- They do not have any disqualifying criminal history that would pose a threat to national security or public safety.
Because many undocumented immigrants have longstanding roots in the United States, often in the form of families, businesses, or close ties to their communities, we anticipate that there will be hundreds of thousands, if not millions of immigrants who can benefit from this new Parole program. This includes folks in removal proceedings at an Immigration Court, folks with minor criminal convictions, and even the children of undocumented immigrants in certain circumstances.
Because this new Parole program is still being finalized by the Biden administration, it remains to be seen what the final rules and eligibility criteria will be. As such, we encourage potential and current clients to revisit this page periodically for updates. However, there are ways to prepare yourself to be among the first applicants when the time comes. We recommend:
- Gathering proof of having resided in the United States since June 17, 2014. This evidence may include tax filings, pay stubs, bank account statements, proof of auto, mobile, or medical insurance, school records, etc.
- Gathering proof of a lawful marriage to a U.S. citizen;
- Gathering proof of your citizenship and identity, such as a passport or a birth certificate, along with a certified English translation if in a foreign language;
- Gathering any records of arrests or convictions you may have to discuss with Attorney Khan or Attorney Brooks to help determine your eligibility to apply for Parole in Place.
